Please read these Terms and Conditions and our Privacy Policy (collectively the “Terms”) carefully, as you agree to consent to these Terms by your use of this website or SalesOptAI’s services, as described further below.
Acceptance of the Terms
The Terms are entered into by and between you (referred to herein as “you” and/or, if you have subscribed to SalesOptAI, as “Subscriber”) and SalesOptAI (“SalesOptAI,” “we,” “our,” or “us”). These Terms govern your access to and use of the SalesOptAI website and/or SalesOptAI software (collectively the “Platform”) and SalesOptAI services (the “Services”), whether as a guest or subscriber.
By using the Platform, you accept and agree to be bound and abide by these Terms of Service and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms of Service or the Privacy Policy, do not access or use the Platform or any SalesOptAI Services. If you have concerns, please get in touch with us, and we will attempt to assist.
Term
This agreement remains in full force and effect while you use the Platform. All provisions of the Terms shall survive termination by either party, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Eligibility
The Platform and Services are intended only for access and use by individuals at least eighteen (18) years old. If you are not at least eighteen (18) years old, you are prohibited from both the access and usage of the Platform and Services.
Changes to the Terms
We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Platform and Services thereafter. Your continued use of the Platform or our Services following the posting of revised Terms means you accept and agree to the changes.
Services Provided by SalesOptAI
Virtual Assistant Services
SalesOptAI provides AI-powered virtual assistant services to its subscribers, including but not limited to:
- AI voice assistants for call handling
- AI chat systems for customer engagement
- AI email responders
- AI SMS and social media management
- Task automation and integration services
These Services may evolve over time, and any additions will be covered under these Terms.
Usage Guidelines
All plans are subject to SalesOptAI’s Reasonable Use Policy to ensure fair and non-abusive use of Services. Subscribers must comply with all applicable laws and refrain from using the Services for any unlawful purposes.
Payment Terms
Service Plans
SalesOptAI offers subscription-based plans for its Services. Payment is required at the beginning of each subscription term, and payments are non-refundable. Subscribers are responsible for any additional charges incurred due to overages or additional features requested.
Accepted Payment Methods
We accept payments via credit and debit cards processed securely. Supported card types include Visa, MasterCard, American Express, Discover, and others as applicable.
Processing and Billing Details
Payments for subscriptions and services are securely processed by our trusted third-party payment providers. Please note that our trusted third-party payment provider may appear as the merchant on your card statement.
Overage Charges
In the event that your use exceeds the allocated plan limits, overage charges will apply as specified in your selected plan details.
Failure to Pay
If timely payment is not made, SalesOptAI reserves the right to suspend or terminate your subscription and block access to the Services.
Refunds and Discounts
SalesOptAI does not provide refunds for unused portions of subscriptions unless otherwise required by law or explicitly stated. Discounts, if offered, are applied at the time of purchase and are non-transferable.
Prohibited Activities
Use of the platform or services for illegal transactions or activities is prohibited under SalesOptAI’s terms and is strictly forbidden.
Intellectual Property Rights
SalesOptAI retains all rights, title, and interest in and to the Platform, Services, and any related intellectual property. Unauthorized use, reproduction, or distribution of any aspect of the Services is strictly prohibited.
Data Usage and Confidentiality
Handling of Subscriber Information
SalesOptAI collects, stores, and processes subscriber information as necessary to provide the Services. All data is treated confidentially and is not shared with third parties except as required by law or explicitly permitted by the Subscriber.
Security Measures
SalesOptAI employs industry-standard encryption and access controls to safeguard your data. Any breaches will be communicated promptly, and corrective measures will be taken. All payment transactions are processed using secure systems. Your payment information is encrypted and handled in compliance with industry standards and applicable laws.
Data Deletion Requests
Subscribers may request the deletion of their data by contacting support@salesoptai.com. SalesOptAI will ensure data is permanently deleted within 30 days of verification of the request.
Recorded Call Notification and Compliance
SalesOptAI’s AI voice assistants include call recording capabilities to ensure quality and service improvements. It is the responsibility of the Subscriber to comply with all applicable local, provincial, state, and/or federal laws regarding the recording of calls. Before using call recording features, you must ensure that you inform all participants that their call will be recorded, where required by law.
SalesOptAI does not assume liability for any failure to comply with call recording notification laws in your jurisdiction. We encourage all Subscribers to consult legal counsel or review applicable laws prior to activating call recording features.
Limitation of Liability
To the extent permitted by law, SalesOptAI is not liable for any indirect, special, incidental, consequential, or exemplary damages arising out of or in connection with the use of the Platform or Services.
Dispute Resolution
For any disputes regarding payments processed, please contact us at support@salesoptai.com. We will work with you and the payment processor to resolve the issue promptly.
Termination
By Subscriber
You may cancel your subscription at any time by notifying us at support@salesoptai.com. Services will continue until the end of the current subscription term.
By SalesOptAI
SalesOptAI reserves the right to suspend or terminate Services for any reason, including but not limited to non-payment, violation of these Terms, or misuse of the Platform or Services.
Post-Termination Access
Upon termination, SalesOptAI may immediately revoke access to the Platform and delete all associated Subscriber data within a reasonable timeframe.
Force Majeure
SalesOptAI shall not be held responsible for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, labor strikes, or governmental actions.
Arbitration and Dispute Resolution
Any disputes arising out of these Terms shall be resolved through binding arbitration in accordance with the rules of the Canadian Arbitration Association. Parties agree to waive any rights to trial by jury.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the province of Ontario, Canada. Any disputes arising under these Terms will be resolved in the courts of Ontario.
Feedback and Suggestions
By providing feedback or suggestions to SalesOptAI, you agree that SalesOptAI may use such feedback for any purpose without obligation or compensation to you. All feedback is considered non-confidential.
Third-Party Integrations
SalesOptAI Services may include integrations with third-party platforms. SalesOptAI is not liable for issues arising from the use of these integrations or any data shared with third-party services at the Subscriber’s request.
Service Availability and Maintenance
SalesOptAI strives to maintain high levels of service availability but does not guarantee uninterrupted access. Planned maintenance or unforeseen outages may temporarily disrupt services, and notice will be provided where possible.
